The digital market: Digital Services Act, Digital Markets Act, Platform-to-Business Regulation—Commentary

Iga Małobęcka-Szwast is the author of the commentary to Art. 5, 6 and 9 of the Digital Markets Act in the first Polish book covering the EU’s regulation of the entire sector of online platforms.

The volume provides the first such extensive commentary in Polish on the EU laws referred to in the title:

  • The Digital Services Act (Regulation (EU) 2022/2065), which focuses on creation of a safe digital space for users and businesses
  • The Digital Markets Act (Regulation (EU) 2022/1925)), designed to ensure a level playing field for all internet businesses, regardless of size
  • The Platform-to-Business Regulation ((EU) 2019/1150), which addresses the specific sphere of relations between providers of online platforms intermediating in conclusion of contracts and customer contacts, as well as internet search engines, and businesses using these services to reach customers.

The commentary discusses in detail issues of e-commerce, competition, consumer protection, and data protection, due to the many areas where the DSA and the DMA overlap with the General Data Protection Regulation.
