Advice for clients from the insurance sector
We have experience with the most unusual and demanding insurance products, including insurance of spacecraft and insurance products tied to nuclear and military risks.
We advise participants in the insurance sector (policyholders, insurance companies, injured parties, reinsurers) on corporate insurance products, particularly coverage for:
- Directors and officers (D&O)
- Construction all risks and erection all risks (CAR/EAR)
- Professional indemnity (PI)
- Property damage and business interruption (PD&BI)
- Warranty and indemnity (W&I)
- Cyber insurance
- Trade credit insurance.
We provide legal support for distribution of insurance products. We advise businesses (including from the e-commerce and retail segment) on distribution of embedded insurance products.
We advise participants in the insurance sector (policyholders, insurance companies, injured parties, reinsurers) in the most demanding disputes, including cross-border matters. We have experience handling cases where the amount in dispute runs to tens of millions of euro.
We advise clients concluding reinsurance agreements. We assist in negotiations and in disputes between the parties, including disputes involving captive insurance firms.
We advise insurance distributors, particularly foreign insurers and managing general agents (MGAs) cooperating with them, implementing new insurance products and adjusting them to suit local legal requirements and various sales channels (such as bancassurance).
We support insurance companies in mass handling of claims, at the loss-adjustment stage and in the courts, under vehicle insurance (civil liability and comprehensive cover) as well as other mass-distributed insurance.
We advise insurance companies, brokers and agents in regulatory disputes, particularly with the Polish Financial Supervision Authority and the Financial Ombudsman, including disputes over fines imposed by regulators and administrative decisions affecting our clients’ business operations.
We support participants in the insurance sector on all compliance issues. We assist them in fulfilling their regulatory obligations (e.g. notifications in connection with transfers of insurance portfolios) and in adjusting their procedures to meet standards of soft law (particularly recommendations and guidance issued by regulators).
