Regulatory advice

• We have prepared regulatory handbooks for a Dutch fertiliser manufacturer, an American seed producer, and a German cosmetics manufacturer, among others.
• For a German automaker, we prepared a regulatory report on the possibility of offering autonomous cars on the Polish market.
• We prepared a memorandum on labelling of saws and mowers in Poland.
• We advised on the possibility of marketing borderline products (between medicines and dietary supplements) in Poland and the risk of notification proceedings before the Chief Sanitary Inspector.
• We have advised on matters related to marketing, labelling and application of plant protection products, as well as management of waste packaging from plant protection products containing hazardous substances.
• We have prepared guides and instructions on how to proceed in the event of an unannounced inspection (dawn raid) by the Office of Competition and Consumer Protection for clients from various industries.
• For several foreign banks and investment firms, we have prepared documentation connected with opening of a branch or representative office in Poland.
• We have advised several banks and brokerage houses on adjusting their internal regulations to comply with the requirements of the Markets in Financial Instruments Directive.
• We have advised public companies on compliance with reporting requirements under the Market Abuse Regulation.

Regulatory proceedings

• We represented a leading producer of genetically modified foods in a dispute with regulators before the administrative courts concerning the ability to sell GMOs in Poland.
• We represented a distributor of plant protection products before the Minister of Health and the president of the Office for Registration of Medicinal Products, Medical Devices and Biocidal Products in a case involving product registration.
• We represented a manufacturer of dietary supplements in a proceeding before the Chief Sanitary Inspector related to compliance with requirements concerning ingredients and notification of dietary supplements.
• We have obtained approval from the Polish competition authority for over 200 concentrations on Polish and foreign markets.
• We conducted a comprehensive audit of the activity of management personnel of a major producer of construction materials, including review of email correspondence with representatives of customers and suppliers, together with an analysis of commercial contracts, followed by preparation of a post-audit report and recommendations and training on compliance with competition regulations.
• We conducted and supervised a mock dawn raid by the Polish competition authority and prepared post-inspection recommendations for a client operating in the liquid fuels market.
• We have represented clients in proceedings before the Polish Financial Supervision Authority (KNF) in matters such as obtaining brokerage licences and consent to acquire shares of a brokerage.
• We have represented clients in proceedings before KNF concerning alleged violations of law.
