Employment disputes

We conduct judicial disputes arising under employment law, including disputes involving:
  • Termination of employment contracts, with claims for damages or reinstatement. Such claims may arise out of termination of an employment contract on grounds attributable to the employee, group layoffs, disciplinary firing, or individual and group layoffs as part of employment restructuring, often as a consequence of reorganisation following M&A transactions, or headcount reductions resulting from economic conditions.
  • Claims for payment of salary, including overtime, bonuses, severance and benefits under social packages
  • Violation of non-competition agreements and acts of unfair competition, which represent a significant portion of the employment litigation handled by the firm. Such cases are increasingly important under conditions of stiff competition and because the actions and consequences can be so harmful to the employer’s business.
  • Mobbing, discrimination and infringement of personal interests seeking damages and other relief. These are sensitive cases because of the impact such claims can have on the reputation of the client and its employees.
  • On-the-job accidents and professional illnesses, involving claims for damages for personal injury, often high in value and with far-reaching consequences in terms of claims for future damages
  • Disputes with board members and senior management, often connected with allegations of acting to the detriment of the company, including violation of non-competition agreements (e.g. through acts of unfair competition). Civil disputes in this area are often related to parallel criminal proceedings for economic offences. In cases of this type, we cooperate with criminal law practitioners.
  • Disputes instigated by trade unions, e.g. seeking to invalidate commercial contracts
  • Proceedings before administrative agencies and administrative courts, e.g. concerning decisions issued by the National Labour Inspectorate. We represent our clients in administrative proceedings for legalisation of employment and residence of citizens of third countries in Poland, including deportation proceedings.

 

Alongside a comprehensive, individualised litigation strategy, we provide support for our clients in obtaining specialised knowledge necessary to assure full protection of their interests. For example, in cases alleging mobbing or on-the-job accidents, we cooperate with expert witnesses, occupational health and safety specialists and medical specialists.
