Intellectual property disputes

We represent parties to disputes concerning intellectual property before administrative authorities, the administrative courts, and civil and criminal courts, including disputes concerning:
  • Trademark infringement, involving unlawful use of identical or confusingly similar marks which are misleading to consumers. We act against infringements by commencing civil proceedings, often seeking interim relief to secure the claim, and also using measures provided by criminal procedure. We represent trademark holders before the customs service, which is entitled to seize goods at border crossings.
  • Famous and renowned trademarks. Such marks enjoy special protection due to their prestige and their exceptional distinguishing power for consumers. We represent a large number of owners of such prominent brands.
  • Patents, chiefly for pharmaceuticals, chemicals and biotechnology
  • Copyright, involving creative works, from traditional categories such as literary and visual works through decorative arts, product packaging and advertising slogans
  • Industrial designs, most often involving the appearance of products such as toys, furniture and cosmetics packaging. These disputes are conducted before the civil courts, and obtaining interim relief to secure the claim is an essential element of the proceedings.
  • Unfair competition, including imitation of the external form of products, misleading product names, unfair advertising, and infringement of trade secrets
  • Protection of personal interests such as image, reputation, and business names
  • Online infringement of intellectual property rights, from unlawful registration and use of internet domain names through sale of counterfeit and pirated goods, creation of false associations using trademarks or business names belonging to others, or links to illegally distributed works
  • Registration and maintenance of exclusive rights, or conflicts between exclusive rights, including trademarks, industrial designs and patents, conflicts between rights registered at the Polish Patent Office and, for example, at the European Union Intellectual Property Office – EUIPO (formerly OHIM) in Alicante, Spain. Such cases are resolved through administrative proceedings. We conduct such proceedings in cooperation with highly experienced patent attorneys.
