We conduct litigation involving insurance law, including:
- Claims for compensation from insurers under insurance coverage. Such disputes may be based on the primary liability of the insured to third parties for redress of loss or breach of an obligation, and secondary liability of the insurer under civil liability insurance, as well as cases where the insured seeks indemnity from the insurer for a loss it has suffered (e.g. for insurance of buildings or equipment or against lost profit). In such cases we represent insurers, insureds and injured parties.
- Disputes between reinsurers and insurers. These disputes primarily involve differences in assessment of the grounds for recognition of a claim by the insured and payment of compensation by the insurer to the insured or other person entitled to payment under the coverage, where the reinsurer subsequently refuses under the reinsurance agreement to cover some or all of the compensation paid out by the insurer to the insured. In such cases we represent insurers and reinsurers.
- Proceedings before the Office of Competition and Consumer Protection and the Court of Competition and Consumer Protection over treatment of provisions of insurance contracts as impermissible clauses.
We provide our clients support in the form of specialised knowhow necessary to assure complete protection of the clients’ interests. In such cases as complex claims related to construction or medical events, we cooperate with experts in specific fields.
