- We provide ongoing immigration support to a US client providing services to US military bases in Poland and other countries in the Schengen Area. We have assisted the client in obtaining hundreds of temporary residence permits in Poland for its staff seconded here, so they do not need to renew their national visa annually and can freely travel to other countries in the Schengen Area. Due to the special status of the client (regulated by a treaty between Poland and the United States), on several occasions the Polish authorities made an erroneous interpretation of the regulations or took an unfavourable (inflexible) approach. We were able to overcome all of these complications by obtaining an official position from the head of the Office for Foreigners and applying non-standard solutions. We also assist the client’s employees in obtaining visas to Poland, coordinating the cooperation with Polish diplomatic missions around the world and collaborating with our colleagues from partner law firms abroad. We also act as a 24/7 emergency contact for urgent issues affecting the client and its employees, for example when they need to cross borders around the world.
- We provide comprehensive legal services for a global leader in immigration services, operating in over 170 countries through more than 60 local offices. Working for this client requires a deep understanding of global relocation, the needs of newcomers to Poland, and the client’s operational environment. We assist the client in matters related to legalising work and residence for foreign employees in Poland and posting employees to Poland. We advise on work and residence rights of EU citizens in Poland, as well as the situation of Ukrainians and other foreigners under Polish employment regulations. We assess work eligibility, resolve complex immigration issues, represent employers and foreign staff in various administrative proceedings, and file applications on their behalf. Our thorough and professional approach ensures that each case is handled with precision and efficiency.
- We provide ongoing legal support and advice to an international religious organisation, primarily concerning legalisation of residence in Poland of missionaries, and other related matters. We help legalise their stay, file appeals against unfavourable determinations, and assist missionaries in their departure from Poland when they have not managed to obtain a residence permit before the end of their mission. Recently we developed a new model for filing applications for temporary residence permits in Poland, due to the substantial delays in processing of these applications. This approach enables missionaries to secure temporary stay permits more quickly or to leave Poland without significant issues from border authorities, even if there are delays in processing of their applications by local authorities. Additionally, we assist the client in resolving any problems arising with the Polish authorities, and advise on various aspects of missionaries’ presence in Poland (such as driving licences, rental agreements, and obtaining a Polish personal identification number). We represent missionaries and the client in their interactions with Polish authorities, including province governors, the Border Guard, and the Police. We also serve as a 24/7 emergency contact for the client and missionaries if they have any urgent issues.
- We provide comprehensive support to a global leader in the clothing sector in matters related to the legalisation of work and stay for its foreign employees in Poland. We represent both the client and its employees in a multitude of immigration procedures, liaising with Polish authorities, including labour offices, province governors, and the Border Guard. We assist in relocations of the client’s employees to Poland along with their entire family. We assist Ukrainian nationals impacted by the war in Ukraine, and advise the client on deploying its employees to other countries. The client has retained us to conduct the most intricate immigration cases, with complex factual and legal aspects.
- We assisted a Korean client and its contractors completing a major project in a special economic zone in Poland in bringing their employees (about 80 Korean citizens) to Poland based on special entry permits from the Polish authorities (including the Ministry of Foreign Affairs and the Prime Minister), introduced under special legislation in Poland related to the Covid-19 pandemic. We also assisted the employees in obtaining special releases from quarantine (mandatory during the Covid-19 pandemic) and permits to work in Poland.
- We work on a number of projects involving relocation to Poland of businesses (mainly organisations from the US or the EU) and their employees, particularly from Ukraine or Belarus. Our services include legal advice and assistance in legalisation of work and stay in Poland of employees (including individuals providing services based on B2B contracts) and their family members. We also assist in completing other formalities and dealing with administrative matters.
- We advised a client on arrangements for posting workers, including assessment of the outsourcing model used by an external provider. We assisted in registration of postings, and in complying with requirements for seconding employees to other group companies in different jurisdictions. Our assistance included issues of employment law (particularly related to working time), as well as immigration, social insurance and tax law.
