Conference: “Best practice between judge and counsel in civil proceedings,” Warsaw, 8 June 2018

A conference at Łazarski University will present standards developed for dealings between judges and attorneys in civil litigation. The code of best practice was drafted by judges, advocates and attorneys-at-law.

The idea of drawing up best practices in dealings between judges and counsel arose following the conference entitled “Best practice between judge and counsel in civil proceedings” at Łazarski University in December 2016.

That conference provided a forum for representatives of both communities to set forth certain mutual expectations which had not been very clearly communicated before. It also showed that dialogue between the judicial community and the bar can improve the functioning of the justice system regardless of legislative initiatives. This was mentioned by experts from foreign jurisdictions where the justice system operates particularly well thanks to proper cooperation between judges and lawyers.

Afterwards, a group of people involved in organising the conference attempted to draft a set of best practices in dealings between judges and counsel in civil matters. The results of this work will be presented on 8 June 2018.

The general principles set forth in the code of best practices will be presented in the first part of the conference, “On the importance of proper cooperation between judges and counsel.” Then the discussion will turn to best practices during pre-trial proceedings (“The advocate as the first judge in the case”), best practices during hearings and admission of evidence (“Good-faith cooperation in clarifying the case”), and best practices at the stage of judgment and appeal (“Cooperation in appellate review of rulings”).

The participants in the panel discussion will include the Hon. Sir Stephen Silber, Desmond Browne QC, Prof. Joseph Hoffmann, adwokat Tomasz Wardyński, adwokat Józef Palinka, Supreme Court Judge Katarzyna Gonera, attorney-at-law Piotr Golędzinowski, adwokat Dr Maciej Plebanek, attorney-at-law Dr Bartosz Karolczyk, Regional Court Judge Dr Aneta Łazarska, Supreme Administrative Court Judge Dr Przemysław Szustakiewicz, attorney-at-law Dr Arkadiusz Turczyn, and Ewelina Milan.

The moderators of the debate will be adwokat Łukasz Lasek and adwokat Stanisław Drozd.
