Favourable settlement in dispute over professional indemnity insurance

In September 2024 a settlement was reached in a case involving one of the firm’s clients under a professional indemnity policy. The dispute, worth over PLN 20 million, arose between parties responsible for a construction design defect and their insurers.
The dispute concerned construction of multi-segment residential buildings and identification of a design defect requiring implementation of a remedial plan affecting the structure of the buildings.
In this case, our firm acted for the investor. At trial and during the settlement negotiations, the client was represented by advocates Mateusz Kosiorowski (coordinator of the Insurance practice) and Dr Maciej Kiełbowski (partner in the Dispute Resolution & Arbitration practice).
