Advice in tender for expansion of waste incineration plant in Warsaw

Warsaw will gain the country’s largest modern incineration plant, which will also deliver heat and electricity to over 10,000 households, planned for 2023. The value of the project is over PLN 2 billion. Wardyński & Partners advised on the tender in which the Korean firm POSCO Engineering & Construction Co. Ltd., which previously completed such projects as the incineration plant in Kraków, was selected as the contractor.

MPO Warszawa, the capital’s municipal waste enterprise, has signed a contract for expansion of the Communal Solid Waste Neutralisation Plant. Warsaw will gain an incineration plant with seven times greater than current capacity. It will be a state-of-the-art facility, and the largest of its type in the country.

The lawyers at the firm advising on the tender in which the contractor was selected were Mirella Lechna-Marchewka, Anna Prigan, Dr Hanna Drynkorn and Katarzyna Śliwak.

Their advice included formulation and submission of inquiries regarding the terms of reference, drafting documents, and compiling and verifying documents confirming fulfilment of the conditions for participation in the tender as well as exclusion from the procedure. The firm acted for the client in appellate proceedings brought by a competitor and in a complaint before the Warsaw Regional Court. We provided the client support at the stage of preparations for signing the contract, in the form of compiling and verifying contract documents and arrangements with the contracting authority involving the formalities that had to be completed prior to conclusion of the contract (performance security and contract insurance).
